We have seen a marked rise in the number of clients contacting us about a prenuptial agreement in the UK.
Whilst prenuptial agreements are perceived by some as unromantic or pessimistic others argue that a prenup can circumvent time, expense and a lot of angst on breakdown of a marriage. Whilst prenuptial agreements are still not legally enforceable in England and Wales (at least at the present) the landlmark decision in the case of Radmacher -v- Granatino in October 2010 gave weight to prenuptial agreements. Also the Law Commission is due to make recommendations to the government on this issue. However, in the meantime we are noting that judges are attaching more weight to a prenuptial agreement and are more likely to uphold them.
When we are asked to advise client's when a prenuptial agreement is in place we ask certain questions. These can include:
How soon was the prenuptial agreement signed before the wedding
Was it negotiated
Was there full and frank disclosure of the finances of both parties
